These Terms & Conditions of Sale ("Terms of Sale") apply to purchases made through BlissfulNights.com (the "Website"). By placing an order through the Website, you agree to these Terms of Sale and any product-specific terms, warranty terms, return or trial policies, and promotional terms applicable to your purchase.
For purposes of these Terms of Sale, "Blissful Nights," "we," "us," and "our" refer to Blissful Nights, a brand operated by South Bay International, Inc.
1. Product Descriptions
We make reasonable efforts to accurately describe our products, including their materials, construction, dimensions, specifications, features, colors, images, and other characteristics.
Actual products may vary from photographs or digital representations due to differences in lighting, display settings, manufacturing tolerances, material variations, production changes, compression, expansion, and the inherent characteristics of foam, textiles, wood, metal, and other materials.
Mattresses and other soft or upholstered products may have reasonable dimensional and appearance variations resulting from manufacturing, packaging, shipping, expansion, and normal material characteristics.
We reserve the right to make nonmaterial changes to product specifications, components, materials, packaging, or construction from time to time.
If a product contains a material variation from the description applicable when your order was placed, we will provide any remedy required by applicable law.
2. Product Pricing, Reference Prices and Promotions
Product Prices
We strive to offer competitive pricing on our products.
Prices, product availability, promotions, discounts, and other offers displayed on the Website may change from time to time.
Unless otherwise stated, prices are displayed in U.S. Dollars. Applicable taxes and any shipping, delivery, installation, removal, or other charges will be disclosed where applicable.
Reference Prices
Where a strike-through or other reference price is identified as a suggested retail price ("SRP"), the SRP is provided as a reference price.
An SRP does not necessarily represent the price at which Blissful Nights previously sold the product, the prevailing market price, the regular retail price, or a former selling price. An SRP may also differ from prices offered by other retailers.
Unless expressly identified as a former or previous selling price, an SRP or reference price should not be interpreted as a representation that Blissful Nights previously sold the product at that price.
Promotional Pricing
From time to time, Blissful Nights may offer promotional prices, discounts, coupon codes, bundles, gifts with purchase, or other special offers.
The availability and terms of promotions may vary by product, size, configuration, customer, sales channel, geographic area, or promotional period. Certain products may be excluded.
Products may be offered at the same or lower prices during future promotional events. A current promotion does not guarantee that the same price or promotion will be available in the future.
Unless otherwise stated, promotional offers may not be combined.
All promotional pricing and savings representations are subject to applicable law.
Pricing Errors
We make reasonable efforts to maintain accurate pricing. If a price is displayed incorrectly because of a typographical, technical, system, application, data-feed, or other error, we reserve the right, to the extent permitted by law, to correct the error or cancel the affected order.
If we cancel an order after collecting payment, we will refund the applicable amount to the original payment method.
3. Promotional Codes, Bundles and Gifts
Promotional codes and special offers may be subject to additional terms disclosed with the applicable promotion.
Unless otherwise stated, promotional codes have no cash value, may not be redeemed for cash, may not be applied retroactively to completed purchases, and may not be combined with other offers.
Promotions may contain eligibility requirements, product exclusions, expiration dates, minimum purchase requirements, quantity limitations, or other disclosed restrictions.
If a product is provided without additional charge or at a special price as part of a qualifying purchase, the terms of that promotion will govern the treatment of the promotional product if some or all of the qualifying purchase is returned.
Where clearly disclosed and permitted by applicable law, the value of a retained promotional item or allocated bundle discount may be reflected in the amount of a refund.
4. Orders and Order Acceptance
Submitting an order through the Website constitutes an offer to purchase the products included in the order.
Receipt of an order confirmation or order number confirms that we received your order but does not necessarily constitute final acceptance of the order.
We may refuse or cancel an order where permitted by law, including because of product unavailability, payment authorization issues, suspected fraud, quantity limitations, shipping restrictions, or a material pricing or product-information error.
If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.
We may establish reasonable purchase or quantity limitations for particular products or promotions.
5. Payment
You agree to provide current, complete, and accurate billing, shipping, and payment information.
By submitting a payment method, you represent that you are authorized to use it and authorize the charges associated with your order.
Payments may be processed through third-party payment processors. Availability of particular payment methods may vary.
All purchases through the U.S. Website are transacted in U.S. Dollars unless otherwise expressly stated.
6. Financing and Installment Payments
We may make third-party financing or installment-payment services available, including services presented through Shop Pay or other providers.
Financing and installment-payment products are provided by the applicable third party and are subject to that provider's eligibility requirements, credit approval, terms, disclosures, and privacy practices.
Blissful Nights does not determine or guarantee financing approval or the financing terms ultimately offered to you.
Any monthly payment amount displayed on the Website is an estimate unless otherwise stated. Actual terms, payment amounts, interest rates, and eligibility are determined by the applicable financing provider.
7. Shipping and Delivery
Available shipping or delivery methods, charges, and estimated timeframes will be disclosed on the Website, during checkout, or in connection with the applicable product.
Any shipping or delivery date is an estimate unless expressly stated otherwise.
If we cannot ship an order within the time stated when you placed your order, or within the time otherwise required by applicable law, we will provide the notice, cancellation opportunity, consent request, refund, or other remedy required by law.
Delivery after shipment may be affected by carriers, weather, holidays, geographic conditions, natural disasters, labor disruptions, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate shipping address.
8. Delayed Shipments
If we learn that we cannot ship your merchandise within the timeframe represented when your order was placed, we will handle the delay in accordance with applicable law.
Depending on the circumstances, this may include notifying you of a revised shipment date and providing you with the option to agree to the delay or cancel the affected order for a refund.
Nothing in these Terms of Sale limits any right you have under applicable federal or state order-fulfillment laws.
9. Order Changes and Cancellations
We begin processing orders promptly.
If you wish to change or cancel an order, contact us as soon as possible at info@blissfulnights.com.
We cannot guarantee that an order can be modified or cancelled after processing, production, packaging, or fulfillment has begun.
If an order has already shipped, the return or trial policy applicable to the product will govern.
Nothing in this section limits any cancellation right provided by applicable law.
10. Sleep Trials, Returns and Exchanges
Certain mattresses may qualify for a sleep trial. The applicable trial period, break-in requirement, eligibility criteria, return procedure, and exclusions are stated in our applicable Sleep Trial or Return Policy and/or on the applicable product page.
A mattress sleep trial applies only to products expressly identified as eligible for that trial.
Adjustable bases, foundations, frames, pillows, protectors, bedding, accessories, clearance products, final-sale products, and other merchandise may have different return periods, conditions, or exclusions.
You are responsible for reviewing the return and trial terms applicable to the product you purchase.
Product-specific return or trial terms control over this general section with respect to the applicable product, to the extent permitted by law.
Nothing in a voluntary return or sleep-trial policy limits statutory consumer rights that cannot lawfully be waived.
11. Return Conditions
Returned products must satisfy the conditions of the return or sleep-trial policy applicable to the product.
We may request reasonable documentation needed to process a return, exchange, or claim, including proof of purchase, photographs, product labels or law tags, serial numbers, and information regarding the condition of the product.
Products damaged through misuse, abuse, improper installation or support, unsanitary conditions, unauthorized modification, or use inconsistent with product instructions may be excluded from voluntary return benefits, subject to applicable law and warranty rights.
12. Refunds
Approved refunds generally will be issued to the original payment method.
The time required for a refund to appear in your account may depend on your bank, card issuer, financing provider, or other payment processor.
Unless otherwise stated or required by law, expedited shipping, delivery, removal, installation, or other service charges may not be refundable.
If a purchase involved a promotional bundle, discount, gift, or other special offer, the refund may reflect the promotional allocation associated with the returned product as disclosed in the applicable promotion and permitted by law.
13. Adjustable Bases, Foundations and Accessories
Return eligibility for adjustable bases, foundations, frames, pillows, bedding, protectors, and other accessories is determined by the policy applicable to that product.
The availability of a mattress sleep trial does not mean that an adjustable base, foundation, frame, accessory, or other product purchased with the mattress is subject to the same trial.
Any product identified as final sale, nonreturnable, or subject to a different return period will be governed by the terms disclosed for that product, subject to applicable law.
14. Damaged, Defective or Incorrect Products
Please inspect merchandise promptly after delivery.
If your order arrives damaged, defective, incomplete, or materially different from what you ordered, contact info@blissfulnights.com as soon as reasonably possible and provide your order information and any reasonably requested documentation.
We may request photographs, packaging information, product labels, serial numbers, or other information necessary to evaluate the issue.
Nothing in this section limits rights available under an applicable written warranty or applicable law.
15. Warranties
Certain Blissful Nights products are covered by written limited warranties.
The applicable written warranty describes its duration, coverage, exclusions, claim procedures, and remedies.
A product warranty is separate from a sleep trial or voluntary return policy.
Where a written product warranty conflicts with these general Terms of Sale regarding a warranty matter, the product-specific warranty controls to the extent permitted by law.
Nothing in these Terms of Sale excludes, restricts, or modifies any warranty or consumer remedy that cannot lawfully be excluded, restricted, or modified.
16. Risk of Loss and Delivery
Risk of loss and responsibility for merchandise will be determined in accordance with applicable law and the shipping or delivery arrangement applicable to your order.
If tracking information indicates delivery but you did not receive your merchandise, contact us promptly so that we can investigate the shipment with the applicable carrier.
Nothing in these Terms of Sale eliminates any responsibility imposed on us by applicable consumer-protection law.
17. Third-Party Services
Certain aspects of a transaction may involve third parties, including payment processors, financing providers, shipping carriers, delivery providers, or other service providers.
Third-party services may be subject to their own terms and privacy policies.
Our use of a third-party provider does not eliminate any responsibility that applicable law places on Blissful Nights as the seller.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLISSFUL NIGHTS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM A PURCHASE OR TRANSACTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING FROM A PRODUCT TRANSACTION WILL NOT EXCEED THE AMOUNT PAID TO US FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY TO LIABILITY OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
Some jurisdictions do not permit particular exclusions or limitations. In those jurisdictions, this section applies only to the extent permitted by law.
19. Governing Law
These Terms of Sale and purchases from Blissful Nights are governed by applicable federal law and, to the extent applicable and permitted by law, the laws of the State of California, without regard to conflict-of-law principles.
Nothing in these Terms of Sale deprives a consumer of protections or remedies that cannot lawfully be waived under applicable law.
20. Severability
If a provision of these Terms of Sale is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate.
The remaining provisions will remain in effect.
21. Changes to These Terms of Sale
We may update these Terms of Sale from time to time.
When changes are made, we will update the "Last Updated" date above.
Unless otherwise required by law, the Terms of Sale applicable to a purchase are generally those in effect when the applicable order was placed.
